Senator Pérez's education bill mandates that California schools and colleges immediately notify their entire communities when immigration officers are present on campus, expanding existing requirements for handling immigration enforcement activities at educational institutions.
The legislation requires K-12 schools, community colleges, California State University campuses, and qualifying private colleges to alert all students, parents, faculty, staff and other community members about immigration officers on their premises. The University of California system is requested, but not required, to implement these notification protocols. Under current law, educational institutions must report law enforcement requests for immigration-related information or campus access to administrative leadership while maintaining confidentiality of identifying details.
The bill preserves existing provisions that prohibit schools from collecting immigration status information except when required by law or needed to administer state/federal education programs. It maintains requirements for institutions to adopt model policies limiting assistance with immigration enforcement and ensuring campuses remain accessible regardless of immigration status. The Commission on State Mandates will determine whether affected educational entities qualify for state reimbursement of costs associated with implementing the new notification systems.
