Senator Blakespear's military family childcare legislation creates a licensing exemption for family childcare homes certified by U.S. Armed Forces branches that exclusively serve children of eligible federal personnel and surviving spouses. The measure establishes oversight requirements while maintaining health and safety standards for these specialized providers.
Military installations certifying exempt facilities must file annual provider lists with the State Department of Social Services, report injuries and deaths, and ensure providers post notices about their certification status. Certified providers must maintain staff trained in first aid and CPR, document attendance, implement emergency plans, follow transportation regulations and safe sleep guidelines, and undergo regular safety inspections.
The Department of Social Services retains authority to inspect exempt facilities for compliance and must develop specific policies for these providers by July 2026, in consultation with military branches. The legislation also prioritizes annual inspections for facilities participating in Department of Defense fee assistance programs through county quality rating improvement systems.
The measure defines eligibility according to Department of Defense criteria and maintains existing exemptions for other categories of childcare providers, including health facilities, clinics, cooperative parent arrangements, and certain educational programs.
