Senator Cervantes proposes accelerating California's timeline for issuing state identification cards to eligible residents who cannot provide federal proof of authorized presence, moving the deadline from July 2027 to January 2026. The measure maintains existing requirements for applicants to demonstrate California residency and identity through specified documentation.
The Department of Motor Vehicles must develop implementation regulations in consultation with law enforcement, immigrant rights organizations, labor representatives, and other stakeholders. Acceptable documentation includes consular identification documents, foreign passports, birth certificates, utility bills, rental agreements, and other records specified in the bill. Non-English documents require certified translation or a translation affidavit.
The legislation preserves current privacy protections and anti-discrimination provisions. Documents submitted for identification cards remain confidential and exempt from public records requests except in limited circumstances such as criminal proceedings or urgent public safety needs. The bill authorizes a temporary administrative fee through June 2030 to offset implementation costs. State agencies, businesses, and employers are prohibited from discriminating against individuals based on presenting identification cards issued under these provisions.
